Company says Bryan Arnett posed as staffer, made 'profane' comments to customers

A popular YouTuber has been slammed with a suit by a similarly popular fast-food chain. CBS News reports that the In-N-Out burger franchise has sued internet personality Bryan Arnett, accused by the chain of impersonating one of its workers, interacting with customers, and making "lewd, derogatory, and profane remarks" in an attempt to soil the restaurant's brand. Per the complaint filed last week in California district court, Arnett dressed up in a phony In-N-Out employee uniform and showed up at multiple In-N-Out locations, where he took customer orders and engaged in eyebrow-raising conversation, per KTLA.

Among some of the things the chain says Arnett did while pretending to be an In-N-Out staffer: "stating that In-N-Out had cockroaches and condoms in its food, and that In-N-Out Associates put their feet in lettuce served to customers," according to the complaint. He's also accused of playing around with the chain's "animal style" menu options by asking customers if they wanted their meals "doggy style."

In a video that's been since removed, Arnett responded to the suit and didn't seem particularly concerned. "When I went out and filmed the video, I kinda knew what kind of waters I was stepping into," he said, per SFGate. "I wouldn't say I'm worried about the lawsuit. ... Like yeah, sure, it'll probably be annoying or whatever, but whatever's gonna happen is gonna happen."

In-N-Out is suing for trademark infringement and business defamation. It's also seeking to have Arnett banned from any of its eateries and wants him to scrub his online presence of any references to In-N-Out. The company is suing for damages and any profit he may have earned from such posts. As of this publishing, it appeared any related prank videos had been set to private or otherwise removed from Arnett's public YouTube channel, which has nearly 335,000 subscribers.
