McCain drew sharp contrasts between his legal philosophy and that of both Democratic hopefuls before an audience in North Carolina. He specifically criticized Obama for voting against the confirmation of John Roberts and Samuel Alito, saying Obama favored "activist" judges who do not respect the constitution. "Apparently, nobody quite fits the bill except for an elite group of activist judges, lawyers, and law professors who think they know wisdom when they see it—and they see it only in each other," McCain said of Obama's position.
